These Terms, Waiver & Release of Liability apply to all bookings and participation in the Foilone Earn Your Wings experience operated by:

(“Foilone”, “we”, “us”)

By completing a booking and/or participating in the Earn Your Wings experience, you agree to the following:

1. Nature of the Experience

Earn Your Wings is a guided hydrofoil experience conducted using the Foilone Pegasus electric hydrofoiling watercraft on Lake Como, Italy.

Each session lasts approximately two (2) hours and includes:

• Safety briefing
• Equipment provision
• Professional coaching
• On-water progression
• Support RIB supervision

Participation is voluntary.

2. Eligibility & Participant Requirements

By booking and participating, you confirm that:

• You are at least 18 years old (or have legal guardian consent).
• You are able to swim competently and stay afloat independently in open water.
• Your body weight does not exceed 100 kg.
• You are in good physical and mental health.
• You do not suffer from any medical condition that would make participation unsafe.
• You are not under the influence of alcohol, drugs, or medication that may impair safe participation.

For Duo Sessions, the booking party confirms these requirements for both participants.

Foilone reserves the right to refuse participation if these conditions are not met.

3. Acknowledgement of Inherent Risks

Hydrofoiling is a dynamic water activity involving inherent risks, including but not limited to:

• Sudden acceleration, deceleration, or directional changes
• Loss of balance or control
• Falling into water
• Contact with equipment, hydrofoils, or water surface
• Changing weather and water conditions
• Collision with objects or other vessels

You understand and accept that falling into the water is a normal and expected part of the experience.

These risks may result in injury, illness, property damage, or other loss.

You voluntarily assume all risks, known and unknown, associated with participation.

4. Release of Liability

To the fullest extent permitted by applicable law, you release and hold harmless Foilone Oy, its directors, employees, contractors, agents, and partners from any liability for injury, damage, loss, or expense arising from participation in the experience, except in cases of gross negligence or willful misconduct.

Participation is undertaken voluntarily and at your own risk.

5. Instructor Authority & Conduct

Participants agree to follow all safety briefings and instructions provided by Foilone staff at all times.

Foilone reserves the right to terminate a session without refund if a participant:

• Fails to follow instructions
• Engages in unsafe or reckless behavior
• Is disrespectful toward staff
• Appears under the influence of alcohol or drugs

Safety decisions are final and made solely by Foilone.

6. Equipment & Property Damage

Participants agree to treat all equipment with reasonable care.

In the event of intentional damage or damage caused by reckless or negligent behavior, Foilone reserves the right to seek compensation for repair or replacement costs to the extent permitted by law.

Normal wear and tear or accidents occurring during compliant participation are not subject to automatic liability.

7. Booking & Payment

Full payment is required at the time of booking.

Prices are stated in EUR and include applicable VAT unless otherwise specified.

A booking is confirmed only upon successful payment.

8. Cancellation Policy

• Free cancellation up to seven (7) days before the scheduled session.
• 50% refund for cancellations made two (2) to seven (7) days before the session.
• No refund for cancellations made within two (2) days of the session.
• No-shows are non-refundable.

Refunds are processed within fourteen (14) days.

9. Weather, Technical & Force Majeure

Safety decisions are made solely by Foilone.

If weather, water conditions, or technical factors are deemed unsafe, the session will be rescheduled to the next available slot.

If no suitable alternative is available during the guest’s stay, a full refund will be issued.

Foilone shall not be liable for failure to perform due to events beyond reasonable control, including but not limited to severe weather, governmental restrictions, natural disasters, strikes, or other force majeure events.

10. Media Consent

Unless explicitly declined in writing prior to participation, you grant Foilone permission to photograph and/or record video during the experience and to use such material for marketing, promotional, and commercial purposes across digital and print channels without compensation.

If you do not consent, you must notify staff prior to the session.

11. Data Protection

Personal data is processed in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR), and Foilone’s Privacy Policy.

Data is collected for operational, safety, customer relationship, and legal compliance purposes and may be shared with necessary service providers.

12. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with applicable law at the place of operation.

Any disputes arising from or related to participation shall be subject to the competent courts of that jurisdiction.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
